The Village Board of the Village of North Freedom adopts the following ordinance:

SECTION 1: Purpose.

The Village of North Freedom has adopted various ordinances that regulate the use and development of land and buildings within the Village and amendments must be made to the Zoning Ordinance from time-to-time to keep the policies current, reflect current practices, and address new issues and circumstances.  It has been determined that the Village of North Freedom should have definitions and regulations in place to properly control the placement of shipping containers or like structures.

SECTION 2: Code Sections Affected.

Village Code Section 16.3.12 is hereby created.

SECTION 3. Codes Sections as Affected.

3.12   STORAGE CONTAINERS AND LIKE STRUCTURES

  2. No bulk storage container, temporary storage container, "pod," or similar container shall be placed or maintained on any private property in any zoning district unless it complies with one or more of the following provisions:
  • Such containers may be placed or maintained on a driveway or other suitably paved areas for the purposes of packing or unpacking goods and materials of the owner or occupant of the property in preparation for and/or subsequent to moving into or out of the property for not more than 30 consecutive days with a maximum of one container per property.
  • Such containers may be placed or maintained on a driveway or other suitably paved area for purposes of storing the goods and materials of the owner or occupant of the property when necessary during renovation or rehabilitation of the structures located on the premises in which the goods or materials would otherwise be located during the period of renovation or rehabilitation and up to 10 days prior to commencement and 10 days subsequent to completion of the work. This time period may be extended by the Village Building Inspector for an additional period not to exceed 30 days.

Prior to the placement of any bulk storage container, temporary storage container, "pod," or similar container on any private property within the Village, the user of such containers shall apply for and receive a permit from the Village Building Inspector pursuant to the provisions and standards set forth herein.

  1. The permit application shall require, among other things, the name and contact information for both the owner of the container and the owner of the property with which the use of the container is associated.
  2. The application shall be accomplished by a permit fee as listed within the fee schedule for the placement, as outlined herein, of a bulk storage container, temporary storage container, "pod," or similar container.
  3. No permit issued shall be transferable or assignable to any person, business, organization, or other party not originally designated on the original application.

The owner of the property associated with the container use shall be responsible for compliance with the provisions of this chapter.

SECTION 4: Validity.

Should any section, clause or provision of this Ordinance be declared by the courts to be invalid, the same shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so declared to be invalid.

SECTION 5: Conflicting Provisions Repealed.

All ordinances in conflict with any provisions of this Ordinance are hereby repealed.

SECTION 6: Effective Date.

This Ordinance shall be in force from and after its introduction and publication and as provided by statute.
